Encountered an intermittent problem during heavy rain and when washing the car, afterwards when I opened the tailgate water would pour out of the lock mechanism. So took it to BMW as it is under extended warranty and it transpires that the seals on the lights on the inside of the tailgate are the issue and so water get in and collects (you can see this as water sits in the bottom of the lights).
It then turns out that seals are not covered under the warranty, however, upon further investigation by the dealer with BMW they have apparently changed the seals on further models, hence they knew and hence they have decided to cover it………………………….so check your seals ladies and gents.
