3.0D Fuel Injection Warning at high Revs

Had the X5 for a few months and love it, but having an issue with the fuel inection system, any advice would be much appreciated.
Warning comes up when booting it, ie at full throttle when it hits around 4k RPM. It first did this once a few weeks ago after it was run quite low on fuel (around 20 miles range left), light pinged up when I was leaving the services at full whack. Its not done it since until tonight (to be fair I dont often get the chance to put my foot down), now everytime I hit 4k rpm on comes the light, switch the engine off and drive 'normally' and its fine.
Is it worth me changing the diesel filter (easy to get to?) or is that just wishful thinking!
