When it says:

'The vehicle will automatically fail the MOT test if the filter had been fitted as standard but is found to be no longer present.'

Does this mean since they were law (from 07 or 08 or whenever it was) OR if they were standard on the car whenever it was built?

Just asking as a relative has an E60 with delete (iirc by Jason) but it's an 2005 model.

Garage next door to me has recently had 3 merc sprinters in all of which have been de-catted and remapped......1 is now being scrapped because it wont run properly anymore and 2 have had problems which are still needing to be sorted out. 

You wont get me to de-cat mine and isnt it a case if the ECU is updated the de-catted map is removed and all hell breaks loose?

Found this also:

The residue which remains after completed regeneration cannot be removed and will fill the filter. DPFs are designed to last about 75,000 miles but operating correctly, we see many cars achieving more than this.


Dam......Bought mine on about 3 weeks ago with 77K, not sure weather its got a new DPF or the Original.....time shall tell  :scared: :scared:

[/quote]If you get people to do the job that are in-experienced or don't know what they are doing yes you will get problems. I did about 40K in my last two BMW's and they both had cats/dpf's removed and the software was re-mapped to compensate by people that new what they were doing. Both cars drove better and had better mpg over the factory map.
If you read on some of the other BMW forums you will see many happy customers that have been running for years with no cats/dpf's.
The following have a very good reputation to get the mapping right and have many happy customers:- Jason from BWchiptune, Stan from Ecotune, Simon from Emaps, Rich from Oscarli etc.

If a customers car had an ECU update at the dealer any good mapper would reload the software for you if it was removed, I had a flash unit for our last BMW so I could actually flash the code back myself if it was removed.

[/quote]I think the way it reads is if it was fitted as standard when it was built, a guy at work has a 10 plate diesel and that has no dpf on it so it wasn't law then.

[/quote]Touch wood at the moment we are on 132K and original dpf. I think its the higher mileage motorway cars that seem to make the dpf's last much longer.

[/quote]If it was done by Jason he usually removes the filter blocks from the dpf and gets it welded back up.
That way the dpf is still present, unless its been cut open and welded in an obvious place that the MOT tester can see you may be ok.
Also the emissions test  on a diesel is staying the same at the moment ie the smoke levels are still 3 and 1.5 for cars 08 onwards.

Also, I have a late 2007 (registered in Dec).  I pay the higher tax band, would that mean I don't have a DPF hence the high tax band?

[/quote]You will still have a dpf, all the 3l diesels BMW engines from late 05 have them.
Your car must have been built before Sep/Oct 07 because thats when BMW lowered the CO2, we were fortunate to get a Dec 07 registered 3.0d that was built in Nov hence we get the cheaper tax.

They don't.  It was a dealer fit option only.  The E53 was Euro III only.
