I have also added some info re reporting deadlines to allow for abscence of complying at the location.

......Of course in any doubt re legals you should call the Police & or your Insurance again.

Hi Minda,

It is more than likely going to be a very long and drawn out process for you. My advice would be, don't take it to heart, don't get stressed out by the situation and leave it to the insurance company's to sort out. I had a claim about five years ago (a lorry shed some stones on the motorway that battered my car but the driver drove off) you can get caught up in it all and it seemed like the most important thing in the world to make sure they didn't get away with it and from experience the other insurance company is as devious as the scumbags that claim in these low impact collisions. After all the stress and hassle I did win the case out of court (by about 5 mins!!!) and it was a relief when it was all over.

My father in law was involved in a very similar situation to you and the passengers in the other vehicle multiplied like mogwai as the claim progressed...in the end it went to court and they weren't daft and threw it out and fined the driver for lying.

Never been on this end before, had a few taps before where others have come into to me, inspected and if no damage just get on our way as you do. but these two just seem geared up to make a injury claim when they have none. :x

It really is unbelievable what some people will do to try and make a quick buck, the :wkr: 's

It's almost enough to put you off driving in heavy traffic.

I agree with Pete, Minda. Don't let it get to you if you can, it is too easy to become absorbed by it all, just let the powers of be deal with it.
Odds on that should they try and procceed with thier claim, they will trip thenselves up at some point and expose the scam.

Anyway, my thoughts are with you on this one.

Sorry to hear, but just to confirm this was in the van and not the X?

There are too many low life scum in the world at the minute particular in these hard times

I've only skimmed read the post but I'm sure, knowing AW8 well that anything he has advised is exceptional sound

Hope it isn't too much of a bum ache

There is a lady on bmwland that I can't on with well (we did a driving course together) who has just written off her E93 M3 on some black ice so that is pretty sad to see too

I was a traffic cop for many many years (17 yrs), albeit many years ago before i became an engineer. If the letter of the law was applied strictly you would be guilty of careless driving as you collided with the car in front, albeit very slightly. Accidents like this the police don't want to get involved in due to the amount of paperwork involved hence they just give out ref numbers for insurance companies to show you had reported it. They only get involved now when someone is injured. like the scumbags in the other vehicle trying to make out.
They don't just take statements, they examine the vehicles for damage, amount of damage, take photos etc. The fact the other party tried to stop you from taking photos and no damage, I don't think you have anything to worry about. If your insurance company is worth there premium they will laugh at the other party and tell them to bugger off. You will probably find the other parties insurance will do the same without any evidence. The police didn't attend so no evidence from them. No damage, other party stopping you from gathering evidence. I would be surprised if you hear anything else. Shame you couldn't get any independant witnesses.

and after a good nights sleep it's still getting to me :(

Thanks kena for your wise words, i would not dispute the cause of the incident, the main gripe would be the attitude of the other party and whether they would try and claim for fake injuries, and as regards damage i would really like to see them try as i have two pic's albeit one slightly obscured showing no damage.

And this one's for the scum of the world :voodoo:

Btw if you do decide to total the x5 this week for good measure let me know as I will come and swap wheels before the insurance guys take it away

I'm looking at getting some and it would save me some time and money

Rear pipes probabl going on on Monday and remap booked for friday
