I take it these are just bolt on and play? No need for any map?
What's the benefits of fitting one, apart from the ace sound
It will allow the engine to in take more air
You can fit without a remap
So how does it take in more air? The only way to increase the airflow is to increase the size of the holes in the filter, which in turn allows larger dust particles into your engine. Increased engine wear is hardly a good trade off for a nice sound....If the unit takes in under bonnet air, then that's not good either as hot air is less dense than cold air taken from outside the car, meaning less oxygen and therefore
less power.

Unless the OEM filter actually restricts the airflow by design and these don't, but I get your point about warm air from the engine bay, though in motion that air may well be cooler simply because of the airflow due to motion forcing the warm air out etc.
Of course the position of the induction kit relative to the air coming post-radiator will be important perhaps?
Just musing out loud... :-[

I dont belive that kit+remap will give you 50bhp more from 4.4i engine
) Just make me
) and again
) Kit will give you less if will drag warm air in and it looks messy.

Any filter OEM or otherwise must restrict the airflow to some degree-BMW will have struck a balance between effective filtering and air flow. I also have an E38 and this subject has been discussed many times on various forums, where most owners now avoid this type of filter and oil impregnated types which ultimately destroy MAFs.

The standard filter and air box is very restrictive on the 4.4i x5
The induction kit filter is made from cotton and is not oiled
It also has a much larger surface area than the oem
It also has more feed pipes that feed colder air to it and in tests shows Coolar air than the oem style
Our x5 has been at many roiling road bmw forum days shoot outs and pulled over 320bhp many times and a hell of a lot more when the nos is turned on
Many people have seem our x5 drag racing at Santa pod on the bmw show days for the last 5 years and it has often bet m3s
