I agree with pushing forward. Invest a couple of quid (around £50) in a lawyers letter - then let the solicitor advise you further depending on their response.

I complain about anything that is not of merchantable quality. I remain polite but firm, demonstrate that I'm not going away and quote the relevant sections of Sale of Goods Act. I've had cars repaired and two tv's replaced (one was my mothers) after 3 and half years. Two years ago we replaced the blinds in our house - cost about £1000 - recently one set has started playing up and doesnt open/close properly - they resisted at first but I've pushed further and it turns out they've had a dodgy load of rails supplied to them so are replacing all the blinds in the house.

I would say complaining is hard work but pays off 8 times out 10 - car dealers are the worst, so cut to the chase and talk to a solicitor who specialises in commercial matters (ie dont go to a divorce lawyer - yes they all get the same training, and they will know all the ins and outs of SOGA but it pays to specialise. Most firms don't charge for the initial advice and often a letter (chargeable to you) pays off.

The dealer has the right to decide it is is a repair replacement or refund so do nothing without their permission. You cannot pay out for a new cassette then necessarily expect them to pay - even with another party diagnosing, the dealer could argue that it could have been repaired for £50 and thats all you may then get. And document every phone call, email etc in the meantime. If speaking to someone there get their full name

And without saying anything negative or libellous against the dealer, purely for the provision of information to the rest of us, can you say which trader you bought from please?

I have occasional problems with the roof sticking in tilt.  Ive found that a regular wipe around the edges of the panels with some silicon grease helps to clean any dirt away and lubricates it enough to shut.

Its worth having a clean of the mechanism and all the channels it runs through before getting too worried about a new cassette.

My month old car has gone back to big motoring world for roof not opening.
They triee a repair which didn't work so now they have ordered a new cassette.  It's been with them for 3 weeks now.
I have one of there courtesy cars a 1 series

Jeez, are BMW still suffering from that issue?  That's been going on since the E53 version.  If the parts have to come from Germany then it seems to be taking a while.  I'm still waiting for parts ordered 6 months ago!!

I know this is an old post, but anyway.......

A relatively simple dremel job can be performed on the roof to disable the rear tilt mechanism. Once done you no longer have a stuck roof and it operates as normal less the rear tilt. For anyone with a pan roof on their E70, you save £1000 and to be honest will probably not notice any real difference.

Adam owns and runs the above and sorted my wife's Mk1 Mini Cooper Cab's roof when the cable snapped on one side (a known fault on Mk1s), and replaced the part with the genuine BMW part from a Mk2 Mini Cab.

Excellent service, very reasonable cost...  and only 20 mins from Guildford to Dorking :)
