The lacquer coat appears to be coming away just below the rear windows has anyone else experienced this? Is this a warranty claim on my 06 car does it matter that I am not the original owner?

Depends upon whether there's a full BMW service history. BMW will fight tooth and nail to avoid any warranty claim on a car not fully maintained by them.

if your clear coat is peeling you can bet your life its been rep-sprayed in that area at some time in its past life.
if its just one panel its probably not going to be real expensive to repair
try your luck with BM, but unless they did the repair i think you would have Buckeyes
