I have an update.
After the sales chap discussed the matter with the Manager, they would like to contribute to the costs and want to know how much the tyres are going to cost and control arm and geometry check, not sure what that means. So I am going replying tomorrow with costs and what I expect them to pay for, and to what percentage I will expect them to contribute to the other items.
I will be asking for total coverage of the control arm and geometry.
Half the cost of the tyres as they were over half worn which I think is fair enough.
Not sure what to say about the brakes, as again I did not expect them to be new, but there again they should have informed me they were near the end of their life (we could of haggered money off on this basis) or replaced them at the time. So I need to sleep on the brakes.
I am not too bothered about the reversing camera, and I think the warranty will cover that anyway, the oil leak is slight according to Clayton cars and is not important yet, they said they will look at it again just before the warranty expires.

Same here, I have always found them extremely honest and helpful, I spoke to them yesterday about the tyres and geometry, I was asking if we could dial out some of the negative camber to try and stop them wearing on the inside again, I don't want to go too extreme, just maybe take them to the advised limit or slightly passed it.

Easy once they start talking to lose sight of acceptable resolution. I agree on suspension, geometry & tyre wear but would be careful not to be too eager on the reverse camera. IMO it should work and its the clearest cut aspect here without any real wear & tear expectation in short ownership it either works or it doesn't. You could of course use funds for this to offset your balance of other costs. Do make sure you have correct price quoted so you know how much it will cost to repair this.

+1 on the camera sometimes niggly small things like that may cost some £££ it maybe something more sinister you never no.

Wise words as always AW8 While you have been calm over this Tortuga the selling garage really should not have let this vehicle be delivered in such a condition!!! It may be the case that it is too far/too much hassle to take the vehicle back to get these problems sorted but that's not your problem. If sellers like this get away with poor prep/sale condition and get no/little fuss from the buyer, they'll just keep on doing it to every other bloke who buy's from them >:D

I need to be realistic about what I am going to get, a court will not give me new value on consumable parts, but will on faults. If they don't agree I will just go through the courts. As far as the discs are concerned I have said that they have either not checked them or they knew they were at or below the limit of wear and chose not to tell me. So I am looking for a significant contribution to these as either way their business practices are bad.

The latest is.
They have agreed to pay for one rear tyre.
Pay for the upper control arm replacement
Pay for the Geometry/tracking check and adjustment.
They have refused to pay for or contribute to the brakes as they say I did not give them the opportunity to check or remedy the issue prior to authorising the work. I am not happy about this as he has admitted that they were low, and I have said "so why not tell me when I was buying" = No answer to this.
I spoke to the warranty company today concerning the reversing camera, they have said to get it looked at and get the garage to call them, they say should not be a problem.
So today 2 new rear tyres went on, I get strange enjoyment when new tyres are on my cars and bikes, I don't know why? The other work takes place tomorrow. Camera might get looked at tomorrow, or another day.
But either way the dealer is poor, but I am happier and I am looking forward to driving the car. Next job after this is to get new roof box bars and clamps so I can put my Kamei box on for camping in the summer as the bars and clamps wont fit the sport flush bars that the car has. I set out to buy an SE as the bars are the same as my old 330d, but I got seduced by the MSport looks.

OP - I'm glad you have got some of the issues sorted. But clearly disappointing about the brakes.
Don't take this the wrong way, but I did state earlier in the thread that not allowing the seller to look at/ rectify your vehicle first could be an issue if you went down the "claims route". Sadly they have used the fact that you sorted the problem with out them having the opportunity to deal with the issue, allowing them to wriggle out of paying up.
This should be a leason to any future buyers. Always give the supplying garage the opportunity to rectify issue first. If you get no joy then sort it your self via a claim.

But I live in Somerset and the car was bought from Warwick, so the chances of going back with bold tyres and shot brakes was not likely an option. The other reason was that my Wife took it and collected it, when I got home from work she casually mentioned some other issues other than brake pads. I called the garage the next day to ask about the discs and what other issues there might be.
It is a lesson for anyone else though, SYTNER are NOT GOOD. They have done the bare minimum knowing that by the time I was going to be back in Somerset with it, I was going to be getting my wallet out.
Camera is getting fixed under warranty so thats good.

It should be noted that the OP did not by from one of Sytners main BMW dealers, but from a used car site owned by them. There is no way this car would have come from a main dealer in the condition it was in when sold >:D

It did go to their main dealer site for the oil service and vehicle check as they are the ones who stamped the book ::)
