I believe under current law you have 6 months to reject the car. Our illustrious Government want to reduce it to 30 days for cars!! Garage has to have the 'opportunity' to put it right or refund and replace.

You don't have to give them a chance to fix faults. You can reject straight away.
I may expand on my experience on that later.:-X
Also it's upto 6 months to report a fault/issue where it is deemed to have been there since purchase by consumer law and up to the seller to prove otherwise. Anything after 6 months after purchase up to 6 years later and its up to the buyer to prove, which sounds like you have done and can prove it's a manufacturer issue.

Will wait and see what they come back with. So far the dealer has been extremely helpful and understanding. As I've said before, I'm not looking for compensation, I just want what we ordered. Fingers crossed they can resolve one way or another. My wife and her business partner are on their 3rd new BMW in 6 years aside from my X5 so we've been pretty loyal of late...

Spoke to the dealer this morning and they are going to proceed with a rebuild. The key issue with the SOS button etc cannot be retrospectively fixed (or at least not at a reasonable cost).

The plan is they will order a new one and when it arrives (c10 weeks), they will swap it over. Need to work through tyre wear and stuff like that but really pleased.
