You don't have to give them a chance to fix faults. You can reject straight away.

Also it's upto 6 months to report a fault/issue where it is deemed to have been there since purchase by consumer law and up to the seller to prove otherwise. Anything after 6 months after purchase up to 6 years later and its up to the buyer to prove, which sounds like you have done and can prove it's a manufacturer issue.

New build issue
My mistake, I should have said my wife's X1 was delivered in Sep 12 so within the 6 months. My X5 was Sep 11.
Will wait and see what they come back with. So far the dealer has been extremely helpful and understanding. As I've said before, I'm not looking for compensation, I just want what we ordered. Fingers crossed they can resolve one way or another. My wife and her business partner are on their 3rd new BMW in 6 years aside from my X5 so we've been pretty loyal of late...

New build issue
Spoke to the dealer this morning and they are going to proceed with a rebuild. The key issue with the SOS button etc cannot be retrospectively fixed (or at least not at a reasonable cost).
Very pleased with the outcome and the way the dealer (Elms Cambridge) and BMW have dealt with it.

That's great news. Out of interest, was the dealership quick to concede a rebuild or did you have to push, threaten legal action etc?

I'm assuming rebuild means shipped back to country of manufacture for a refit? Good result but trust you get something to run round in in meantime?

Yes they are. If it wasn't related to a safety feature, I think it would have been compensation offered.

New build issue
The dealer quickly identified it as a manufacture issue - possibly down to the fact that X1 LCI was only just out when it was ordered. They handled it all, no need for me to threaten legal action or anything like that. It was just great customer service, they seemed mortified that this could happen.
The plan is they will order a new one and when it arrives (c10 weeks), they will swap it over. Need to work through tyre wear and stuff like that but really pleased.
