I have a simple question:
If your manager approves time sheets then the company (same manager) say you weren't on site a number of days past 12 months then its 'gross misconduct' ?

Hi I' m no lawyer but would depend on what the companies HR policy said about it. The person will need to check on it. Also if in a union can always ask them for advice.
I know at my Council it can be considered gross misconduct if recording attendance incorrectly so when completing time sheets we are able to go to nearest 5 minutes but its best to err on the side of caution.
It does seem a bit odd that a company is now questioning the persons attendance, when it has previously been signed off by a manager in the company.
The person may need to prove their attendance could be via emails sent on those days, record of telephone calls or meeting attended, car park log, cctv etc, basically anything that would help substantiate the situation.

Falsfying records could well be Gross Misconduct no matter whether it was signed off or not, at the end of the day the employee is responsible for the correctness of the records, just because the manager didn't check it doesn't remove the initial blame. As above proof of attendance would be important.
