First X5 I had was from an independent dealer, non-BMW, battery failed in the first few weeks- they paid me for a replacement, no quibble. So if they are really legit, they should replace the battery - BMW AUC warranty covers the battery in the first year after purchase as well.
pvr, I tend to keep my cars for ever and ever......managed 7years with the old Rangey, I have had the 4.8 for 2 years now, probably a keeper for at least another 3 or 4 depending on how troublesome it becomes:)

Mailed the dealer to tell them the car will be going in for diagnosis this Friday.
They came back and said they will cover the cost of the battery if it needs replacing...result
