Oil
Hi all should the oil on my dip stick be all the way to the top , is this wrong or damaging the engine

Oil, in any vehicle, should only be filled to the maximum mark indicated. Overfill is just as bad as underfill but in different ways but to put simply f it is above the maximum then it is not doing the engine/componentry any good. The maximum mark is there for a reason !

As above, but also wait just a few mins (5 will do) for the (warmed) oil to drain back to the sump, and check it on level ground. Part of my drive is sloped slightly and makes a difference to the reading!
If it's still way over the mark, then you can get oil removers that go down the dipstick hole and you can then suck a bit out. Saves messing about under the car

I have one of them (pella500) makes oil changes really easy

Unless you were also seeing a lot of blue smoke I would think it's unlikely. But get any overfill out as soon as you can is definitely a course of action to take.
It's not unusual to see a little over the max mark, and usually with no ill effects at all.
See what it looks like when all is wiped off and settled and rechecked. You'll be fine

23 of jan oil light came on filled up now oil lights on again !!!!! There is a very very little damp spot underneath but NOT on the floor any ideas where it's going !!?

How far have you driven since then? These engines do use oil. I think the BMW spec for the M57 diesel engine allows for about 0.5 litre/1,000 miles. Mine certainly used oil at that sort of rate when new but the rate slowed as the miles went on, but it always burned some oil between services. I expected that at some point the 'burn rate' would eventually climb again through normal wear.
The current N57S engine doesn't seem to use any at all so far.

What's the dipstick showing? I had a bad sensor replaced within 3 months of getting the car. The BMW Assistance Driver who came out said it was a 'known problem' with both the level and pressure sensors. Used to scare the cr@p out of me when the 'Stop! Low Oil Pressure!' warning came on.
I think the bottom to top mark is 1 litre so if you've only done 150 miles and lost that much oil and not laying a clear smoke trail then you have a leak - although your description of the vehicle and drive state belies that view.
