Split/cracked driver seat!

I bought a 2012 M Sport with 63k miles from a dealer. The X5 has now covered 66.5k and I have just noticed two splits in the leather(?) on the side of the driver seat just above the seat adjustment controls! I have sent photos to the dealer (Harry Fairbairn, Irvine) and they have said they will not put this right as this is wear and tear consistent with age and mileage!! Surely this can't be right! Anybody else experienced this? Thanks
