I have booked in to an bmw indi next to where I work conveniently, on Wednesday to do a full diagnostic see what he comes back with.

Well I just spoke to the bmw indi  regarding my trans fail safe messge and brake light issue, and he said he has done all the checks and said there were a few errors and they are all pointing to the brake lights being on, he said he has tried an aftermarket switch and that hasn't fixed it and has ordered an original one to try tomorrow, and if that doesn't work I have to take it to an electrician....

What do you guys think?

So I got the car back today with no luck  :(, the mechanic has suggested to take it to an auto electrician, the saga continues....

Thinking back at when the  false trans failsafe prog message first came up, it started after I had to brake hard coming up to traffic, I am going to assume the brake lights staying on and the trans message are related, the mechanic has tried 2 new brake switches which hasn't fixed it so I can rule that out, looking at the diagrams on the link Steamyrotter posted, could it have something to do with a Hall Effect Brake Pedal Sensor or the sensors next to brake pads that is causing all this?

After searching for "hall effect brake sensor x5" in google I have stumbled across this thread, I wonder if the the same applies for the E53???
